Terms of Service

These terms govern your use of this website. They do not govern any project — every project is covered by its own written agreement.

Effective date: 30 September 2026.

1. Agreement to these terms

This website is operated by RM Stone Design Inc. (“we”, “us”). By accessing or using it you agree to these terms, to our privacy policy and to our website disclaimer, which form part of them. If you do not agree, please do not use the site.

You must be at least the age of majority in your province of residence to submit an enquiry through this website.

2. What this website is not

This site describes the landscape construction services we offer and gives general information to help property owners plan and compare work. Nothing on it is a quotation, an offer capable of acceptance, an engineering opinion, a legal opinion, or advice about your specific property. In particular:

  • Construction detail described here — excavation depths, base build-up, compaction, drainage approaches, wall construction, footing and frost depths — is general industry practice, not a specification for your site and not a description of what any particular project will include. What your property needs is determined by inspection.
  • References to permits, by-laws, height limits and legislation are general and change over time. Requirements differ between municipalities and between parts of the same lot. Confirm what applies to your property with the relevant municipality.
  • Photographs show completed work and illustrate style and type. They are not a promise that your project will look the same; materials, site conditions and design choices differ from one property to the next.

3. How work is actually agreed

Scope, price, materials, schedule, exclusions, payment terms and any warranty are set out only in a written proposal or contract issued after a site visit and accepted by both parties. That document is the whole of the arrangement for that project. Nothing on this website adds to it, subtracts from it, or overrides it, and if the two ever differ, the written contract governs.

4. Enquiries

Sending the consultation form, calling or emailing does not create a contract and does not oblige either party to anything. We may decline any enquiry for any lawful reason. You agree that the information you submit is accurate, that it is yours to give, and that you have authority over the property you are asking about or are acting with the owner’s permission.

If you send photographs, drawings or other material, you confirm you have the right to share them and allow us to use them to assess and respond to your enquiry. We will not publish material you send us without your permission.

5. Acceptable use

You agree not to:

  • use the site for any unlawful purpose, or in breach of these terms;
  • submit false, misleading, abusive or automated enquiries, or use the form to send advertising or spam;
  • attempt to gain unauthorised access to the site, its server or any connected system, or interfere with its operation, including by introducing malicious code or overloading it;
  • copy, scrape or harvest content or data from the site by automated means, other than by search-engine crawlers that respect robots.txt; or
  • frame the site, or present its content in a way that suggests a relationship or endorsement that does not exist.

We may block access to the site for anyone who breaches these terms.

6. Intellectual property

The text, photographs, video, layout, graphics, logo and design of this site are owned by RM Stone Design Inc. or used with permission, and are protected by Canadian and international copyright and trademark law. “RM Stone Design” and the RM Stone Design logo are trademarks of RM Stone Design Inc..

You may view and print pages for your own personal, non-commercial use in considering our services. Any other reproduction, republication, distribution or modification requires our written consent. No licence is granted by implication.

Manufacturer, product and material names mentioned on the site belong to their respective owners and are used only to describe products; their mention does not imply that the owner endorses us or that we are affiliated with it. The self-hosted typefaces this site uses are licensed under the SIL Open Font License and remain the property of their authors.

7. Third-party links

Links to other websites — including our Google Business Profile and government resources — are provided for convenience. We do not control those sites and are not responsible for their content, availability, accuracy or privacy practices. A link is not an endorsement.

8. Accuracy and availability

We take reasonable care to keep this site accurate, but content may be incomplete, out of date or contain errors, and it may be changed, suspended or removed at any time without notice. We may correct errors without being obliged to.

9. Disclaimer of warranties

To the extent permitted by law, the website and all of its content are provided “as is” and “as available”, without any representation, warranty or condition of any kind, whether express or implied — including any implied warranty or condition of merchantable quality, fitness for a particular purpose, title or non-infringement. We do not warrant that the site will be uninterrupted, secure or free of errors or harmful components.

10. Limitation of liability

To the fullest extent permitted by law, RM Stone Design Inc. and its directors, officers, employees and agents are not liable for any direct, indirect, incidental, special, consequential or punitive loss or damage — including property damage, personal injury, loss of data, or the cost of work done or not done — arising from your use of, or reliance on, this website or any information on it, even if advised of the possibility.

Where liability cannot be excluded, our total liability arising from your use of this website is limited to one hundred Canadian dollars (CAD $100). This limit concerns the website only; liability for a project is governed by that project’s written contract.

11. Indemnity

You agree to indemnify and hold harmless RM Stone Design Inc. and its directors, officers, employees and agents from any claim, loss, liability or expense, including reasonable legal fees, arising from your breach of these terms or your misuse of the website.

12. Your statutory rights

Nothing in these terms excludes, restricts or waives any right or remedy you have under the Consumer Protection Act, 2002 (Ontario) or any other law that cannot be excluded by agreement. Where such a law applies, these terms are to be read as limited to the extent it requires, and the rest of them continue to apply.

13. Governing law and jurisdiction

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it, without regard to conflict-of-law rules. You agree that the courts of Ontario have exclusive jurisdiction over any dispute arising from these terms or this website, unless the law entitles you to bring a claim elsewhere.

14. General

  • Severability. If any provision is found invalid or unenforceable, it is limited or severed to the minimum extent necessary and the rest remain in force.
  • No waiver. Not enforcing a provision on one occasion does not waive our right to enforce it later.
  • Entire agreement. These terms, the privacy policy and the website disclaimer are the whole agreement between you and us about the website. They do not replace any written project contract.
  • Assignment. We may assign these terms, for example on a sale of the business. You may not assign them without our consent.
  • Headings. Headings are for convenience only and do not affect interpretation.

15. Changes

We may revise these terms by publishing a new version here with a new effective date. The version in force when you use the site is the one that applies to that use.
